Our Child Custody Practice

Though many in Texas still use the term “custody,” the state of Texas has actually adopted new language to govern the relationship between children and parents in divorce proceedings. Viewing “custody” as implying a form of property right, the Texas Family Code now refers to managing conservatorships and possessory conservatorships. A managing conservatorship grants essentially the same rights that legal custody used to grant — the rights of access to a minor child, as well as the right to participate in decisions that affect the child’s welfare. A possessory conservatorship grants nothing more than access to the child.
